Oakland – A emperor everlasting patient filed a lawsuit against the medical provider last week and claimed that he was sexually abused during an operation, in accordance with a press release from the Zinn law firm.

The victim, 58-year-old Michael Bean from Berkeley, claims in a lawsuit that was submitted on February 14 on February 14 that in a skin cancer surgery in 2024 a medical assistant pushed his penis into his shoulder area. According to the press release, Bean submitted complaints to Kaiser, but never a solution in order that he brings the hospital giant to court.

In an interview with the Bay Area News Group, he called it a “terrible experience” and “one that I had to share.”

“Basically, I was confused, amazed, outraged, freaked out about this entire experience, and (the abuse) occurred pretty much during the entire procedure,” said Bean. The suit names hospitals of the Emperor Foundation and the everlasting Medical Group as a defendant.

In an evidence, Emperor said everlasting officials that they may not comment on the lawsuit because she is energetic, but “would like to be clear that we take such a claim extremely seriously”.

“Protecting the security and well -being of our patients is our priority. In accordance with this commitment, Emperor does not tolerate permanent sexual harassment or misconduct on our premises, ”the reason says.

At Bean, basal cell carcinoma was diagnosed on his left cheek near his ear. Therefore, on February 14, 2024, he made an appointment to remove it within the Mohs clinic of the Kaiser San Rafael Medical Center.

When the appointment, he was treated and instructed by a female doctor and a male medical assistant to shut his eyes and never to talk in the course of the operation or not to maneuver to forestall accidents, in accordance with the press release.

Bean said he took the instructions seriously and the doctor began to remove skin cancer.

But in the course of the operation, Bean said that he played something stiffly against his arm, and although his eyes were closed, he could imagine what it was. It took the lawsuit in the course of the 30- to 45-minute procedure. Bean said he didn’t know whether the doctor was aware of what had happened to him.

“There was no other part of the anatomy of this gentleman, who was near Michael's right shoulder,” said his lawyer Carter Zinn. “It couldn't have been an arm or a kneecap, these goods were not in the immediate vicinity.”

When Bean's operation was accomplished, he said that the medical assistant led him to the waiting area, where he was sitting for an hour when the sample was examined until the identical medical assistant got here back and got it out of the power. He said he said nothing concerning the experience because he was in a “state of unbelief and shock” and desired to go as soon as possible.

Bean said he fought against months of fear and wondered whether experience was a dream or whether it was real. After receiving an e -mail from Kaiser to evaluate his experiences, someone from Kaiser who calls him back. Although he did all of this, he never received a solution, he said.

It is unclear whether the medical assistant still works for Kaiser, but Zinn said that a lawyer from the hospital couldn’t assure him that Bean would not come across the hospital worker. Zinn hopes that the lawsuit will contribute to compensating Bean for the trauma he has suffered, but additionally admitting emperors to reveal his clients – and possibly others – to abuse.

“If a hospital makes a mistake if it has to write a check, it makes them more likely that they will not do it again,” said Zinn.

Zinn encouraged everyone who has experienced sexual assault or abuse and would love to support the national hotline for sexual assault under 1-800-656-4673.

“When abuse occurs, they have two options: they run and hide in the dark and it eats and it eats and it hurts them and the pain continues with the perpetrator and everyone involved,” said Zinn. “Your other option is to move to the light and to shine the bright light of truth, honesty and justice on the incident in order to correct it.”
