OAKLAND — Two people have been arrested and charged with murder in reference to the recent death of a motorist who was flagged down by women before a gunman jumped out of the driveway of a close-by apartment constructing and killed the victim, court records show.

A person named Shawn't Lowe, 19, of San Francisco, and a girl named Nelly Rodriguez-Diaz, 19, of Oakland, were charged with murder and carjacking within the death of 47-year-old Alfonso Najera-Hernandez. Lowe also faces charges of carrying a concealed weapon. Both were arrested Sept. 5 and charged by prosecutors on Monday, records show.

Lowe and Rodriguez-Diaz each turned 19 the week of their arrest, with Lowe having to have fun his birthday in prison. If convicted, they resist life in prison.

Najera-Hernandez was driving along the 1500 block of twelfth Avenue in Oakland just before 2 a.m. on Aug. 10 when two women flagged him down. Investigators said in court documents that the ladies gave the impression to be sex employees because they were wearing lingerie-like clothing and loitering in the world, which is thought for prostitution.

The women spoke briefly with Najera-Hernandez when Lowe allegedly emerged from hiding within the driveway of a close-by residence and attempted to open the door to Najera-Hernandez's automotive. The two struggled for a number of moments, then Lowe allegedly fired at the least one shot, killing Najera-Hernandez.

After the shooting, the 2 women and the gunman reportedly fled in the identical direction. Authorities consider Rodriguez-Diaz was one in all the ladies who stopped Najera-Hernandez. The identity of the third suspect stays unknown and police haven’t yet said whether or not they have made any progress in identifying her.

Lowe and Rodriguez-Diaz were identified through witness statements, “electronic data” and surveillance footage, police said in court documents. Both remain in custody and can’t be released on bail.
