<p>Since that visit to the US military cemetery outside Washington, DC, <a href="https://www.politico.com/news/magazine/2024/09/03/5-things-trump-arlington-cemetery-00177067">News reports</a> and campaign photos have emerged showing the previous president with a broad grin and a &#8220;thumbs up&#8221; gesture behind the grave of an American soldier <a href="https://www.defense.gov/News/News-Stories/Article/article/3741245/kabul-airport-attack-review-reaffirms-initial-findings-identifies-attacker/">killed through the US evacuation from Afghanistan 2021</a>These pictures also show the graves of two US Army Green Berets. </p>
<p>The Trump campaign team later released a video showing images of him at Arlington National Cemetery <a href="https://www.thedailybeast.com/trump-posts-tiktok-from-controversial-visit-to-arlington-national-cemetery">with audio criticizing the Biden administration</a> for his handling of the withdrawal from Afghanistan.</p>

<p>Trump’s political posturing and seemingly carefree demeanor at a spot marked with signs calling it “America’s most sacred sanctuary” have many <a href="https://www.salon.com/2024/09/04/the-point-of-trumps-dishonor-why-the-arlington-debacle-is-about-more-than-the-fallen/">critical comments within the media</a>including <a href="https://www.washingtonpost.com/opinions/2024/09/04/mullen-arlington-politics-trump-afghanistan/">former military leaders</a>.</p>
<p>Trump, for his part <a href="https://truthsocial.com/@realDonaldTrump/posts/113074142531291102">complained to Truth Social</a> on September 3, 2024, that the reports of the incident were a &#8220;fabricated story by Comrade Kamala and her disinformation squad.&#8221; His campaign team says it had permission from the family of a soldier buried in Arlington <a href="https://www.cbsnews.com/news/gold-star-families-trump-arlington-cemetery-harris-response/">for taking photos and videos</a> within the cemetery. </p>
<p>But as a legal scholar <a href="https://scholar.google.com/citations?user=HdP043EAAAAJ&#038;hl=en&#038;oi=ao">Specialized in cemetery law</a>I do know their permission is irrelevant. They will not be cemetery officials. The law allows cemeteries to set their very own rules.</p>
<p>And Arlington National Cemetery has by far the strictest rules of any cemetery within the United States. It is obvious to me that the actions of Trump and his campaign team violate the principles of a spot that requires its visitors to &#8220;behave with dignity and respect at all times.&#8221;</p>
<h2>A singular legal situation – and a novel cemetery</h2>
<p>Arlington National Cemetery, where <a href="https://www.arlingtoncemetery.mil/Explore/History-of-Arlington-National-Cemetery">over 400,000 US soldiers and relations</a> were buried, is one in every of the <a href="https://www.cem.va.gov/">164 national cemeteries</a> established by Congress and administered by the federal government. These cemeteries were <a href="https://www.nps.gov/articles/000/national-cemeteries-history.htm">first created in 1862</a>through the civil war. </p>
<p>Most cemeteries have now been converted into <a href="https://www.cem.va.gov/facts/NCA_History_and_Development_1.asp">Department of Veterans Affairs</a> or <a href="https://www.nps.gov/articles/nationalparks-nationalcemeteries.htm">National Park Service</a>but Arlington National Cemetery stays <a href="https://www.ecfr.gov/current/title-32/subtitle-A/chapter-V/subchapter-D/part-553/subpart-A/section-553.1">under the control of the Ministry of Army</a>. </p>
<p>Arlington will not be an atypical cemetery. According to federal law, it&#8217;s “<a href="https://www.ecfr.gov/current/title-32/subtitle-A/chapter-V/subchapter-D/part-553/subpart-A/section-553.33">a national shrine for the honored dead of the armed forces</a>.&#8221; Therefore, the law states: &#8220;Certain acts and activities which may be appropriate elsewhere will not be appropriate in Arlington.&#8221; </p>
<p>In general, cemetery owners &#8211; religious organizations, local authorities, non-profit organizations, for-profit corporations and families &#8211; determine who may be buried on their property, the dimensions and layout of the graves, and the rights of grave owners. Cemeteries can set rules of conduct for visitors and regulate what activities can happen within the cemetery.</p>
<p>These rules take precedence over the desires of the relations of those buried in a cemetery. For example, cemeteries may prohibit families from placing plastic flowers on a grave or require that headstones make sure shapes or sizes.</p>

<h2>A temporary summary of the events</h2>
<p>Trump visited Arlington National Cemetery on the invitation of members of the <a href="https://truthsocial.com/@realDonaldTrump/posts/113037529550199315">Families of two US Marines</a> killed in a bomb attack at Kabul airport on August 26, 2021. </p>
<p>After the wreath laying ceremony in <a href="https://www.arlingtoncemetery.mil/Explore/Monuments-and-Memorials/Tomb-of-the-Unknown-Soldier">Tomb of the Unknown Soldier</a>which honors Americans killed in war, Trump and his campaign team, accompanied by Marine relations, visited the grave of at the least one in every of those killed Marines.</p>
<p>As Trump&#39;s campaign team took photos and videos of Trump and the others standing among the many graves, a cemetery worker approached him and explained that political activity was prohibited at Arlington. A Trump campaign staffer reportedly ignored the warning and &#8220;<a href="https://www.npr.org/2024/08/27/nx-s1-5091154/trump-arlington-cemetery">insulted and pushed the officer aside</a>”, says NPR.</p>
<p>The cemetery worker <a href="https://www.vox.com/2024-elections/369711/trump-arlington-cemetery-controversy-army">reported the encounter to the military police</a> However, he declined to press charges – allegedly because <a href="https://www.npr.org/2024/09/03/g-s1-20680/trump-arlington-cemetery">Fear of harassment by Trump supporters</a>. </p>
<p>The next day, the military itself took the weird step of issuing a <a href="https://www.cnn.com/2024/08/29/politics/us-army-rebukes-trump-campaign-arlington-incident/index.html">formal statement reprimanding a public figure</a> for inappropriate behavior in one in every of his cemeteries. </p>
<p>&#8220;<a href="https://www.npr.org/2024/08/27/nx-s1-5091154/trump-arlington-cemetery">Federal law prohibits political election campaigns</a> or election-related activities at U.S. Army military cemeteries,&#8221; the Aug. 27 statement said, &#8220;including photographers, content creators, or other individuals present for specific purposes or in direct support of a partisan political candidate&#39;s campaign.&#8221; </p>
<h2>Arlington&#39;s Rules</h2>
<p>Many modern cemeteries allow every kind of activities, even <a href="https://historicelmwoodpinewood.org/drop-dead-5k">Conducting running competitions</a> or <a href="https://hollywoodforever.com/culture/">Film evenings</a>. </p>
<p>Not Arlington.</p>
<p>The rules prohibit jogging, bicycling, picnicking, and animals aside from service animals or military dogs. &#8220;Disrespectful and disorderly&#8221; behavior is expressly prohibited at Arlington, and all visitors &#8220;must adhere to reasonable standards of decency and propriety&#8221; while on the cemetery. The rules also prohibit &#8220;<a href="https://www.ecfr.gov/current/title-32/subtitle-A/chapter-V/subchapter-D/part-553/subpart-A/section-553.32">party political activities</a>.” </p>
<p>In general, the <a href="https://www.arlingtoncemetery.mil/Media/Photo-Use-Policy">Public may take photos</a> in Arlington, in addition to the media, with <a href="https://www.arlingtoncemetery.mil/Media/Media-Policy">prior approval and accompaniment</a>However, from at the least April 2022, nobody will likely be allowed to film within the cemetery for “<a href="https://www.arlingtoncemetery.mil/Portals/0/ANC-media-policy.pdf">partisan, political or fundraising purposes</a>“ – and that’s exactly what Trump seems to have done.</p>
<p>His team also violated one other rule – that gravestones can&#8217;t be filmed without written permission from the deceased’s next of kin. Trump’s campaign team apparently received permission from at the least one family to film their relative’s gravestone, nevertheless it <a href="https://www.nytimes.com/2024/08/28/us/politics/trump-arlington-cemetery.html">didn&#8217;t get permission from the families</a> connected to all gravestones visible within the footage. </p>
<h2>Punish</h2>
<p>The rules for visitors to Arlington National Cemetery will not be criminal laws. Violation of those rules cannot lead to a jail sentence or perhaps a superb. Instead, the cemetery&#39;s executive director has <a href="https://www.ecfr.gov/current/title-32/subtitle-A/chapter-V/subchapter-D/part-553/subpart-A/section-553.5">has the authority</a> to remove the perpetrators from the cemetery and prohibit them from returning. <p>US Vice President Kamala Harris on Saturday sharply criticized former President Donald Trump for his filming at Arlington National Cemetery and accused him of exploiting his visit for political purposes, which is prohibited.</p>
<p>&#8220;Let me be clear: The former president violated sacred ground, all because of a political ploy.&#8221; <a href="https://x.com/kamalaharris/status/1829915590468731167?s=46&amp;t=f76SyUZ51_pjCQV8R-qDfA" target="_blank" rel="noopener">Harris</a> wrote in a protracted X-post. &#8220;This is a man who cannot understand anything other than service to himself.&#8221;</p>
<p>Half an hour later, Trump’s running mate, the senator from Ohio, arrived. <a href="https://x.com/JDVance/status/1829925404917837855" target="_blank" rel="noopener">JD Vance</a>shot back at Harris in his own social media post: &#8220;President Trump was there at the invitation of the families whose loved ones died because of your incompetence.&#8221;</p>
<p>“Why don’t you get off social media and launch an investigation into their unnecessary deaths?” Vance added.</p>
<p>The Trump campaign team repeated this line of defense by itself social media <a href="https://x.com/TrumpWarRoom/status/1829921672763224492" target="_blank" rel="noopener">post</a>and responded to Harris: &#8220;You have not EVEN taken responsibility for the 13 heroes killed on your watch &#8211; and this despite boasting about being the last person in the room.&#8221;</p>
<p>Last week, Trump got here under fire for his visit to Arlington Cemetery on Monday. According to a US Army spokesman, his campaign staff &#8220;abruptly pushed aside&#8221; a cemetery employee who was attempting to implement federal laws prohibiting &#8220;political activities&#8221; on military cemetery grounds.</p>
<p>Trump traveled to the cemetery to commemorate the third anniversary of the killing of 13 U.S. soldiers in a bomb attack at Kabul airport in the course of the U.S. withdrawal from Afghanistan. He repeatedly blamed President Joe Biden and Harris for the attack.</p>
<p>While Trump was meeting with the families of the victims, his campaign team took several photos and videos, a few of which were posted on his <a href="https://x.com/TeamTrump/status/1828116646072066302" target="_blank" rel="noopener">Social Media</a> platforms.</p>
<p>Arlington Cemetery issued a press release confirming the incident between the campaign team and the cemetery employee, which NPR first reported.</p>
<p>&#8220;Federal law prohibits political campaign or election activities at U.S. Army military cemeteries, including photographers, content creators, or others who are there for that purpose or in direct support of a partisan political candidate&#39;s campaign,&#8221; the cemetery&#39;s statement said.</p>
<p>The Trump campaign has repeatedly denied any physical altercation and said it had permission to send a photographer and videographer to the location. A Trump campaign spokesman said the incident was the results of a &#8220;psychological fit&#8221; by a cemetery employee.</p>
<p>Trump said on Friday that he only took photos on the scene since the victims&#39; families had requested it.</p>
<p>&#8220;I was standing at different graves with different people and taking pictures. I didn&#39;t want to take pictures, but I wanted to take them if they wanted to take them,&#8221; he said in a moderated conversation with Moms for Liberty co-founder Tiffany Justice.</p>
<p>The Harris team has capitalized on the controversy by mocking Trump for his lack of respect for U.S. troops and pointing to several other incidents by which the previous president faced criticism for allegedly making derogatory remarks about veterans, which he denies.</p>
<p>&#8220;This is nothing new from Donald Trump,&#8221; Harris wrote in her post on Saturday. &#8220;I believe that anyone who cannot fulfill this simple, sacred duty should never again stand behind the seal of the President of the United States of America.&#8221;</p>

<p>Representatives of Vice President Kamala Harris&#39; presidential campaign team said a reported physical altercation between former President Donald Trump&#39;s campaign aides and an official at Arlington National Cemetery was &#8220;quite sad&#8221; but &#8220;it comes as no surprise coming from the Trump team.&#8221;</p>
<p>&#8220;Listen, this is what we expect from Donald Trump and his team,&#8221; Harris campaign spokesman Michael Tyler said in a CNN interview on Wednesday. Arlington Cemetery confirmed late Tuesday that an &#8220;incident&#8221; had taken place and reiterated that <a href="https://www.arlingtoncemetery.mil/Portals/0/ANC-media-policy.pdf" target="_blank" rel="noopener">Federal law</a> prohibits candidates and campaign teams from conducting political campaign activities at national military cemeteries.</p>
<p><a href="https://www.npr.org/2024/08/27/nx-s1-5091154/trump-arlington-cemetery" target="_blank" rel="noopener">NPR</a> reported on Tuesday evening that two members of the Republican candidate’s campaign team got right into a verbal and physical altercation with a <a href="https://www.arlingtoncemetery.mil/" target="_blank" rel="noopener">Arlington Cemetery</a> officially on Monday, when Trump arrived on the holy site with photographers and entourage to take part in a wreath-laying ceremony in a chosen area where probably the most recent U.S. military casualties are buried.</p>
<p>A source told NPR that the official tried to forestall Trump staff from &#8220;filming and taking photographs in that area&#8221; throughout the event, which marked the third anniversary of the deaths of 13 U.S. soldiers killed in a suicide bombing at Kabul airport throughout the Afghanistan evacuation.</p>
<p>&#8220;Donald Trump is a person who wants to make everything about Donald Trump. He is also someone who has a history of humiliating and degrading military personnel, those who have made the ultimate sacrifice,&#8221; Tyler said on CNN on Wednesday.</p>
<p>&#8220;I think that&#39;s part of what the American people resent about Donald Trump. They&#39;re tired of this toxic brand of politics,&#8221; Tyler said.</p>
<p>&#8220;They&#39;re tired of MAGA extremism, and they&#39;re tired of a person who, no matter what the issue is, is frankly just trying to serve himself instead of doing what you&#39;re supposed to do as a leader, which is fight for the American people.&#8221;</p>
<p>In a press release Tuesday evening, Arlington confirmed that &#8220;an incident occurred&#8221; and that &#8220;a report was filed.&#8221;</p>
<p>&#8220;Federal law prohibits political campaign or election activities at U.S. Army military cemeteries, including photographers, content creators, or others who are there for that purpose or in direct support of a partisan political candidate&#39;s campaign,&#8221; the cemetery&#39;s statement said.</p>
<p>“Arlington National Cemetery has reaffirmed this law and its prohibitions and has provided full communication to all concerned.”</p>
<p>The cemetery, operated by the U.S. Army, has a media policy for U.S. national military cemeteries on its website.</p>
<p>The policy states: &#8220;Filming or photography is not permitted if doing so would create the impression that cemetery officials or visitors or family members are promoting a product, service or organization. In addition, pursuant to the Hatch Act, 32 CFR 553 and AR 360-1, the ANC does not authorize filming for partisan, political or fundraising purposes.&#8221;</p>
<p>In the times following Trump’s visit, his campaign team posted videos and photos of the event on social media, including a <a href="https://www.tiktok.com/@realdonaldtrump/video/7407571442088430878?lang=en" target="_blank" rel="noopener">TikTok</a> Video of him in Arlington.</p>
<p>In photos, Trump is seen next to the graves of two Marines killed within the Kabul attack, smiling and giving a thumbs up as he stands next to their members of the family.</p>
<p>The post also features a tag that TikTok adds to some political content, with the text: &#8220;Get information on the US elections.&#8221;</p>

<p>Dan Scavino, a senior adviser to Trump&#39;s campaign, posted a video of Trump in Arlington on the social media site X.</p>
<p>Trump campaign spokesman Steven Cheung denied in a press release Tuesday evening that there was a physical altercation and said, &#8220;We are prepared to release footage if such defamatory claims are made.&#8221;</p>
<p>&#8220;A private photographer was allowed onto the premises, and for some reason, an unnamed individual, obviously suffering from a mental disorder, decided to physically block members of President Trump&#39;s team during a very solemn ceremony,&#8221; Cheung said.</p>

<p>Chris LaCivita, a senior adviser to Trump&#39;s campaign, said Wednesday: &#8220;An unnamed bureaucrat in Arlington, whose job it is to preserve the dignity of the cemetery, is doing the exact opposite by trying to turn a very solemn and respectful event into something it was not.&#8221;</p>
<p>Speaking to NBC News, LaCivita also said that Harris&#39; campaign and other Trump critics were using their comments on the incident to &#8220;obscure the fact that there was only one commander in chief in Arlington on August 26.&#8221;</p>
<p>He was referring to the incontrovertible fact that President Joe Biden, who was in office in Kabul on the time of the soldiers&#39; deaths, didn&#8217;t visit Arlington on the anniversary of their deaths on Tuesday. Harris also didn&#8217;t visit the cemetery that day.</p>
<p>LaCivita, a U.S. Marine Corps veteran, also posted photos of Trump&#39;s visit to Arlington on social media.</p>
<p>On Tuesday evening, he released a photograph of Trump posing with members of the family of fallen service members in Arlington, in addition to a press release from the families of two Marines killed within the Kabul attack, Staff Sgt. Taylor Hoover and Sgt. Nicole Gee.</p>
<p>&#8220;We have allowed President Trump&#39;s official videographer and photographer to attend the event,&#8221; the statement said, &#8220;to ensure that these sacred moments of remembrance are respectfully captured and we can preserve these memories forever.&#8221;</p>
